Acceptance of these terms
These Terms of Service ("Terms") govern your use of AUXIT, a real-time multiplayer music-guessing party game available at playauxit.com ("the Service"), operated by PlayAuxit ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use AUXIT. By using the Service, you represent that you meet this requirement. AUXIT is a general-audience party game and is not directed at children under 13; if we become aware that a user under 13 has provided us with personal data, we will delete it. If you are under the age of majority where you live, you should review these Terms with a parent or guardian.
The Service
AUXIT lets you create or join a game room with other players, pick songs in response to prompts, vote, and see results. Song search results, album art, and preview clips shown in the app are provided by third-party music services (see "Third-party services" below). AUXIT does not host or stream full songs.
Your account
AUXIT creates an anonymous session for you automatically so you can play without signing up. You may optionally link a Google account to keep your progress across devices. You're responsible for any activity that happens through your session or linked account, and for keeping access to your device or Google account secure. Each session is for one person. Don't share a session to impersonate someone else or to get an unfair advantage in a game.
Your content
You keep ownership of the nickname, avatar choice, song selections, and any feedback message you submit ("your content"). By submitting it, you give us a license to store, display, and process it as needed to operate the Service (for example, showing your nickname and picks to other players in your room). You're responsible for what you submit. Don't use a nickname, avatar, or feedback message that is illegal, abusive, harassing, or infringes someone else's rights.
You are solely responsible for the nickname you choose and the songs you submit. AUXIT does not review picks before they are shown to other players in your room. Choose a nickname that is yours to use and that you would be comfortable showing to everyone in the session. Submit music because it genuinely fits the prompt, not to target, demean, or harass another player. We may remove content or suspend access if we receive credible reports of abuse.
Acceptable use
When using AUXIT, you agree not to: interfere with or disrupt the Service or other players' games; attempt to access another player's account or session; scrape, automate, or send excessive requests against the Service or its APIs; reverse-engineer the Service beyond what's permitted by law; or use the Service for any unlawful purpose.
Third-party services
Song search results, album artwork, and preview clips are provided by Apple Music and Deezer through their public search APIs. AUXIT is not affiliated with, sponsored by, or endorsed by Apple or Deezer. Rights to that music and artwork belong to their respective owners, and your use of previews may also be subject to Apple's and Deezer's own terms.
Intellectual property
The AUXIT name, logo, game prompts ("situations"), and the software that runs the Service belong to us or our licensors. These Terms don't grant you any rights to them beyond what's needed to play the game as intended.
Termination
You may stop using AUXIT at any time. We may suspend or terminate your access to the Service if we reasonably believe you've violated these Terms or misused the Service. Some information may be retained after termination as described in our Privacy Policy.
Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We are not responsible for the availability, accuracy, or content of third-party services (including Apple Music and Deezer) that AUXIT relies on. To the fullest extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the greatest extent the law allows. Nothing in these Terms limits any liability, or excludes any right you have as a consumer, that cannot lawfully be limited or excluded under the law that applies to you.
Governing law
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles, except where mandatory local consumer-protection law gives you additional rights that these Terms cannot override.
Changes to these terms
We may update these Terms as AUXIT evolves. We'll update the "Last updated" date above when we do. Continued use of AUXIT after a change means you accept the updated Terms.
